Website Operator & Legal Notice
The ORNIS platform is operated by XINGE TRANSPORT COMMV., a company established in Belgium ("ORNIS", "we" or "our" in these website terms where context permits).
ORNIS is an online platform for curated bird auctions and related enquiries. It is not an open self-service marketplace: owners and breeders may submit birds for consideration, but only authorised ORNIS personnel may create, photograph, approve and publish auction lots.
The contracting seller for each lot, its professional/private status and the role of XINGE TRANSPORT COMMV. will be disclosed before a customer places a bid. ORNIS may also coordinate separately contracted documentation, quarantine and logistics services.
Nothing on this website should be interpreted as a guarantee that a specific bird may lawfully be exported to, imported into or kept in a particular destination country. Applicable permits, veterinary measures and restrictions must be verified for the relevant transaction.
Auction & Purchase Terms
2.1 Scope and priority
These terms govern registration, bidding, online auctions and related purchases made through ORNIS. A lot page and a separately confirmed written agreement may contain additional transaction-specific information. Mandatory applicable law prevails over any inconsistent provision. Any special terms must be disclosed before bidding begins, not introduced only after the auction.
2.2 Two transaction models
Model A — XINGE TRANSPORT COMMV. as seller: the lot identifies XINGE TRANSPORT COMMV. as the contractual seller. The purchase price is paid to XINGE TRANSPORT COMMV. and the sale invoice identifies that company as seller.
Model B — Intermediated sale: the lot identifies the third-party contractual seller, states whether that seller acts as a trader or a private individual, and identifies XINGE TRANSPORT COMMV. as intermediary and expressly authorised collection agent. The buyer pays XINGE TRANSPORT COMMV. in that disclosed capacity, using the invoice/payment instructions issued for the transaction. The sale confirmation and invoice or equivalent legally required document must correctly identify the contracting seller, XINGE's role and applicable tax treatment. The underlying agreement with the third-party seller must authorise collection of the buyer's funds by XINGE and determine settlement to that seller. XINGE is not described as the contractual seller unless it actually assumes that role; mandatory intermediary or platform responsibilities remain unaffected.
In either model, buyers should rely on the seller identity recorded on the individual lot and the corresponding purchase documentation. Any conflict must be resolved before bidding is enabled.
2.3 Accounts, identity and access
Bidding requires an approved ORNIS account. ORNIS may request information reasonably necessary to assess a bidder’s identity, legal eligibility, destination, compliance status and financial bidding limit. Registration alone does not entitle the user to place bids. Account holders must keep login credentials confidential, ensure submitted information is accurate and notify ORNIS promptly of suspected misuse.
Only persons legally permitted to contract and acquire the relevant species may bid. ORNIS may refuse, limit or suspend access on objectively justified grounds such as suspected fraud, non-payment, sanctions or material compliance risks, subject to applicable law.
2.4 Lot description and eligibility
Each published lot identifies the species, quantity, identification information and material characteristics available for that lot, together with any known limitations or qualifications. Statements about sex, age, origin, mutations, parentage, disease testing or breeding history must be identified as verified, seller-reported or unavailable, as applicable. Only the birds specifically described as being sold form the lot.
ORNIS seeks to offer carefully selected quality birds, with the necessary identification and lawful-origin documents appropriate for publication and sale. Documentation needed for a later export or import may be separate from the documents needed for an initial sale.
2.5 Bids, reserve price and closing time
The lot page states the opening and scheduled closing times and the visible bidding rules. Where enabled, the platform may accept confidential maximum/proxy bids, reserve prices and end-time extensions according to the published rules and actual auction-engine configuration. Server-side recorded auction data is used to determine order and timing, subject to the correction of established technical errors.
A bid is an offer with potential payment obligations if accepted and successful, subject always to mandatory consumer withdrawal and other non-waivable rights where applicable. ORNIS does not describe a solely online auction as a statutory “public auction” exempt from distance-selling rules.
ORNIS may investigate duplicate bids, demonstrable system malfunction or attempted manipulation and take proportionate steps, including pausing an auction or invalidating an affected bid where legally permissible. A reasoned record of material administrative interventions should be retained.
2.6 Price, buyer charges and taxes
ORNIS currently charges no buyer's premium (opgeld). The agreed purchase price is the successful bid, with any applicable VAT or taxes identified and correctly displayed before the buyer becomes bound. ORNIS does not add an undisclosed administration charge. Currency is EUR unless the relevant lot expressly states otherwise. Any compulsory charge must be included in the legally required pre-contract price disclosure. Transport, quarantine, veterinary tests, permits and other optional logistics services are outside the bird purchase price unless expressly included, and are quoted and agreed separately. Applicable customs or destination charges and bank fees must be disclosed to the extent required by law.
Buyer's premium: EUR 0 / 0% under the current ORNIS 1.0 policy. No buyer premium may be applied to an auction already open or to a concluded sale retroactively. Any future policy change requires clear prospective disclosure before bidding; it is not part of this release.
2.7 Award, settlement and non-payment
Upon auction completion, subject to the published reserve and acceptance rules and the system's actual behaviour, ORNIS records the winning bid and issues or arranges the correct sale confirmation and invoice. The contractual seller and XINGE TRANSPORT COMMV.'s capacity must be identified consistently on the lot page and sale documents. The buyer shall pay the full invoiced amount by bank transfer to XINGE TRANSPORT COMMV., whether XINGE is the seller or an authorised collection agent for the identified seller. Full cleared payment must be received within seven (7) calendar days from the invoice date; the invoice must show its date and exact due date. This deadline does not run from auction closing or from a separate payment reminder. A bank transfer instruction alone does not constitute receipt of cleared funds.
If the full amount remains unpaid when due, ORNIS may temporarily suspend the buyer's ability to place further bids, notify the buyer in writing, and request payment. Any such measure must be reasonable and consistent with mandatory law and the disclosed bidder policy. If the default is not cured following the legally applicable notice and cure process, the contractual seller may seek termination or resolution of the sale and may offer the bird again. The seller may seek losses legally recoverable under applicable law, but no automatic penalty, deposit forfeiture, collection charge or interest is imposed without a valid contractual and statutory basis. ORNIS will not release a bird for collection, transfer or export before full payment has been received and the applicable documents and release conditions are satisfied.
Consumer-specific reminder and recovery safeguard: where Belgian Book XIX of the Code of Economic Law applies, the first payment reminder must be free of charge and allow at least the statutory fourteen (14) calendar days before any permitted late-payment charge or interest is claimed (with the applicable additional postal calculation where required). Consumer termination, enforcement or collection actions must be reviewed separately against the applicable mandatory notice and unfair-term rules; the 14-day charge-free period is not stated here as an automatic termination rule. For professional buyers, any different recovery arrangements must be contractually valid and compliant with applicable law.
In all cases, the buyer should contact ORNIS promptly if the invoice appears incorrect, payment has already been made, or a lawful withdrawal or other mandatory consumer remedy is being exercised. A suspension or relisting decision must not deprive the consumer of non-waivable rights.
2.8 Collection, veterinary documentation and international transport
Delivery, collection point, packaging, health certificates, quarantine and transport are agreed per lot or in a subsequent written logistics quotation. XINGE TRANSPORT COMMV. can help coordinate these steps using its experience; official permits and entry approvals are issued only by the competent authorities. Buyer-specific import eligibility must be checked before any commitment to ship.
If a proposed cross-border movement cannot legally proceed, ORNIS and the contracting seller will assess available lawful alternatives, postponement or cancellation and any refund obligations according to the facts, the relevant agreement and mandatory law. Neither an auction win nor prior payment creates an entitlement to an unlawful shipment.
2.9 Health and animal welfare
ORNIS selects and professionally presents quality birds and seeks accurate identification, transparent descriptions and the documentation needed for lawful trade. It does not offer a separate voluntary commercial warranty regarding future health, longevity, breeding success or performance. Because birds are living animals, unexpected changes in condition can occur; this does not exclude or reduce any mandatory rights arising under applicable consumer or other law. Any concern about illness or conformity should be reported promptly to the identified contracting seller with available veterinary evidence, without limiting statutory notice or remedy rights.
2.10 Consumer rights, withdrawal and complaints
Where a distance-sale contract is concluded between a trader and a consumer, applicable rights of withdrawal and conformity must be respected. An exclusively online auction does not automatically benefit from the exemption applicable to certain in-person public auctions. If the statutory withdrawal right applies, the buyer must receive the legally required information, timing, procedure and standard form. Any statutory exception must be assessed specifically and not assumed merely because a live animal is sold.
Complaints concerning a lot or transaction may be sent to info@xingetransport.com, stating the lot number, order reference and relevant evidence. Mandatory consumer rights remain unaffected.
2.11 Governing law and disputes
Subject to mandatory consumer protections and conflict-of-law rules, these terms are governed by Belgian law. Any jurisdiction clause must respect applicable rules protecting consumers in their country of residence. The parties should first try to resolve complaints directly before initiating formal proceedings.
Offering Birds To Ornis — Owner / Breeder Terms
Owners and breeders may submit a non-binding bird offer through the Offer Birds form. Submitting an offer does not automatically create a listing, establish a consignment agreement, appoint ORNIS as broker, transfer ownership or require ORNIS to accept the birds.
The person submitting an offer confirms that the information supplied is accurate to the best of their knowledge and that they have the right to offer the birds for consideration. Information should include scientific name, number of birds, location, origin, available identifiers and documents, and any material health or restriction information relevant to the sale.
ORNIS independently decides whether to request further information, inspect the birds, arrange photography or propose commercial terms. No owner/breeder may publish a lot directly or upload a self-managed auction advertisement. Only ORNIS creates and approves live listings.
Before a bird is published, the owner and ORNIS must separately agree in writing which party is the contractual seller, XINGE TRANSPORT COMMV.’s role, who issues the invoice, commission or fees, settlement, custody, transport, compliance responsibilities, and applicable cancellation arrangements.
Personal data supplied through the offer form are handled under the Privacy Notice. ORNIS may decline or close submissions that are incomplete, misleading or unsuitable for lawful trade and animal welfare.

Data may be shared as necessary with banks, hosting and technical service providers, email providers, accountants, professional advisers, transport and veterinary services, competent authorities, and the identified contractual seller. Each recipient should receive only the information needed for its role and lawful purpose.
4.5 Transfers outside the EEA
If personal data are transferred outside the European Economic Area, applicable legal transfer safeguards or other lawful mechanisms must be respected.
4.6 Retention
We retain account, transaction, financial, enquiry and compliance information only for as long as needed for the stated purpose, mandatory legal obligations or the establishment, exercise or defence of legal claims. We assess retention by record category and do not indefinitely retain rejected offers or closed enquiries without a continuing lawful reason.
4.7 Rights
Subject to applicable law, you may request access, correction, deletion, restriction or portability of your data, object to certain processing, or withdraw consent where processing is based on consent. You may complain to the Belgian Data Protection Authority or another competent authority.
4.8 Security and children
Access to internal ORNIS Supervisor records is limited to personnel who need it for their duties. Access controls, updates, backups and suitable processing safeguards must be implemented and reviewed.
